We at Mecharm Digital SL (“we” or “us” or “our”) listen to our users (“user” or “you”) and we are committed to protecting the principles of privacy and fair use that underpin our values to offer a transparent and secure service. We want you to be confident that your personal data is safe and secure with us.

This Privacy Policy applies to our application, Metacharms, (the “App”) and explains how we will collect, use, share, and safeguard your information when you visit App. This Privacy Policy does not apply to the third-party online/mobile store from which you install the Application or make payments, which may also collect and use data about you. We are not responsible for any of the data collected by any such third party.

Please read this Privacy Policy carefully, because by accessing or using our App, you signify that you have read, understood, and agree to our collection, storage, use, and disclosure of your personal information as described in this Privacy Policy. We do not generally collect personal information about users of our App. If, however, any features of the App (existing or future) require the collection of users' personal information, we will only collect information that you provide to us when you interact with our App.

Push Notifications. We may request to send you push notifications regarding your account or certain features of the App. If you wish to opt out from receiving these types of communications, you may turn them off in your device's settings.
This information is primarily needed to maintain the security and operation of our App, for troubleshooting, and for our internal analytics and reporting purposes.

We also may automatically collect certain information when you use our App (such as your Internet Protocol (IP) address and/or browser and device characteristics — is collected automatically when you visit our Services). This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our services, and other technical information. This information is primarily needed to maintain the security and operation of our services, and for our internal analytics and reporting purposes. Log and Usage Data. Log and usage data is service-related, diagnostic, usage, and performance information our servers automatically collect when you access or use our App and which we record in log files. Depending on how you interact with us, this log data may include your IP address, device information, browser type, and settings and information about your activity in the App (such as the date/time stamps associated with your usage, pages and files viewed, searches, and other actions you take such as which features you use), device event information (such as system activity, error reports (sometimes called 'crash dumps'), and hardware settings).

We collect device data such as information about your computer, phone, tablet, or other device you use to access the App. Depending on the device used, this device data may include information such as your IP address (or proxy server), device and application identification numbers, location, browser type, hardware model, Internet service provider and/or mobile carrier, operating system, and system configuration information.

How much information we collect depends on the type and settings of the device you use to access the App. For example, we may use GPS and other technologies to collect geolocation data that tells us your current location (based on your IP address). You can opt out of allowing us to collect this information either by refusing access to the information or by disabling your Location setting on your device. However, if you choose to opt out, you may not be able to use certain aspects of the App.

To personalise and improve aspects of our App. For example, we may process your information to respond to your customer support requests; to receive error messages about any issues you / your device encounters with our App to enable us to fix bugs and interoperability issues; to detecting and preventing illegal activities; to track application installs, for purposes of measuring the effect of our marketing campaigns; to conduct optional user feedback surveys; to remember you next time you visit one of our App; and communicate with you about promotions, rewards, upcoming events, and other news about products and services offered by us;

To communicate with you, including some or all of the following: to provide you with in-app offers and rewards based on your interaction with our App; to serve you with relevant targeted advertisements; to make you offers to purchase in-app items on discount based on your activity with our App and your purchase history; and to send you marketing communications and/or newsletters if you have subscribed for them about rewards and promotions;

To comply with legal obligations, including to prevent and/or detect fraud or provide disclosure to the authorities when required by applicable law.

LEGAL BASES TO USE YOUR INFORMATION

We only use your personal information when we believe it is necessary and we have a valid legal reason (i.e., legal basis) to do so under applicable law, like with your consent, to comply with laws, to provide you with services to enter into or fulfil our contractual obligations, to protect your rights, or to fulfil our legitimate business interests.

Consent. We may process your information if you have given us permission (i.e., consent) to use your personal information for a specific purpose. You can withdraw your consent at any time. by contacting us by using the contact details provided in the section «CONTACT» below. However, if you elect not to supply to or withdraw the data from us, we may not be able to deliver the products and services regarding our App you desire, and this may also result in the automatic termination of any agreements you may have with us.

Performance of a Contractual Obligations. We may process your personal information when we believe it is necessary to fulfil our contractual obligations to you, including providing our services or at your request prior to entering into a contract with you.

Legitimate Interests. We may use and process some of your personal data where we have sensible and legitimate business grounds for doing so. Under European privacy laws there is a concept of “legitimate interests” as a justification for processing your personal data. Our legitimate interests for processing your personal data are for us to enable you access and use of our Services, to communicate with you about our App and to improve our it.

SHARING YOUR INFORMATION

However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorised third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information. Although we will do our best to protect your personal information, transmission of personal information to and from our App is at your own risk.

RETENTION

We will retain your personal information for the period necessary to fulfill the purposes outlined in this Privacy Policy unless a longer retention period is required or permitted by law.

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymise such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

INTERNATIONAL DATA TRANSFERS

MECHARM DIGITAL SL is headquartered in Spain, which may not have the same data protection laws as the country in which you reside. If you are using the App from outside the Spain, your information may be transferred to, stored, and processed in the Spain (or in another country where our servers may be located), just in case we collect any personal information. By using our App, you consent to such transfers of this information.

When we do this, we may act as a “controller” as defined under applicable data protection law when we process your information from the App. Generally, we rely on our legitimate interests when processing this information. These legitimate interests include providing our services, operating the App, and our other business purposes.

We reserve the right to make changes to this Privacy Policy at any time and for any reason. We will alert you about any changes by updating the “Last updated and effective date” of this Privacy Policy. You are encouraged to periodically review this Privacy Policy to stay informed of updates. You will be deemed to have been made aware of, will be subject to, and will be deemed to have accepted the changes in any revised Privacy Policy by your continued use of the Service after the date such revised Privacy Policy is posted.
